Terms

The terms of the subscription.

This is the plain English version of how the subscription works, what we promise to do, and what we ask of you.

Who we are

The Pen Pal Club is a small family business based in New York. The letters are written by Niam, age 7, and illustrated by his brother Eham, age 3. The business side is run by their parent.

What you are buying

A monthly subscription. Each month, you will receive one handwritten letter from Niam, one drawing from Eham, one blank reply postcard, all inside an envelope, mailed via the United States Postal Service.

Pricing and billing

  • The subscription is $12 per month, in US dollars.
  • Your card is charged on the day you subscribe, and then on the same day each month after that.
  • Your subscription renews automatically. You can cancel anytime.
  • If we ever raise the price, we will give existing subscribers at least 30 days notice by email. You can cancel before the increase takes effect.

Cancellation

  • You can cancel anytime by clicking Manage subscription at the bottom of the site, or by emailing hello@thepenpalclub.com.
  • When you cancel, your subscription continues to the end of the month you have already paid for. You will still receive that month's letter.
  • You will not be charged again after that.

Refunds

  • If you subscribed by mistake, email us within 7 days of subscribing. We will refund the most recent charge in full and cancel the subscription.
  • After 7 days, the current month is non-refundable, since the letter has already been written or is being prepared.
  • Past months are not refundable.
  • If a letter fails to arrive due to our fault, email us and we will make it right.

Shipping

  • We ship to addresses in the United States only.
  • We use the United States Postal Service, standard mail.
  • Delivery typically takes 3 to 7 business days from the day we mail.
  • We do not guarantee a specific delivery date.
  • If you move, update your address in the Manage subscription portal or email us.
  • If a letter is lost in the mail and the USPS confirms loss, we will resend a replacement at no cost. If it is lost because the address you provided was wrong, we will resend at our discretion.

Your responsibilities

  • Provide accurate billing and shipping information.
  • Keep your address up to date if you move.
  • Keep your payment method valid. If a renewal fails, your subscription will pause and we will email you.
  • Use the letters for personal enjoyment only. You can share them with friends and family, hang them on the fridge, scrapbook them, scan them for personal keepsakes. You cannot resell them or use them in a commercial product.

What we own and what you can do with the letters

Niam and Eham keep the copyright to the letters they write and draw. By subscribing, you receive a license to keep the physical letter, photograph it, share it with friends and family, and treasure it. You may not reproduce the letters for sale, resell originals as collectibles, or use them in any commercial product without our written permission.

What we do not promise

  • We do not guarantee a specific theme, topic, length, or content for any letter. Niam picks each month.
  • We do not guarantee that a kid will draw a dinosaur or hawk on demand.
  • We may occasionally miss a strict monthly cadence if Niam is sick or out of town. If that happens, you will get a longer letter the following month, or two letters, or a heads-up. We will not skip you.
  • The service is provided as is. We do everything we reasonably can to make it great, but we cannot promise it will meet every expectation.

Limits on our liability

The most we will ever owe you, for any reason, is the amount you paid us in the previous 12 months. This is a $12 a month subscription. We are a small family operation. We are not responsible for indirect or consequential damages.

Termination

We reserve the right to suspend or cancel a subscription at our discretion, including in cases of fraudulent payment activity, unwarranted chargebacks, or abusive conduct toward our team.

Changes to these terms

If we change these terms in a way that affects you, we will email subscribers and update the date at the top of this page. Continued use of the service after a change means you accept it.

Governing law

These terms are governed by the laws of the State of New York, USA. Any disputes will be handled in the state or federal courts of New York County.
